Animal attacks · Kentucky

Owners are responsible.
Period.

Dog bites and animal attacks carry real medical and emotional damages - and Kentucky's owner-liability rules are stricter than most people (including most insurance adjusters) realize. Homeowners' insurance usually pays. We know exactly how to file it.

01 · The problem

Kentucky is not a one-bite state.
The owner is on the hook from day one.

Under KRS 258.235, a dog owner is strictly liable for injuries caused by their dog. No prior-bite requirement. No knowledge requirement. The owner is responsible - period.

Most people, including adjusters, default to the “one bite” rule from common law. That's not Kentucky law. The owner's homeowner's insurance (or renter's insurance) usually covers the claim with policy limits often $100K–$300K.

Children and scarring injuries make these cases real. We handle them with care for the client and clarity with the carrier.

What we do back.

Their tactic“The dog was provoked”
Our counterProvocation is a defense - but a high bar. Documented circumstances usually defeat it.
Their tactic“Trespasser” defense
Our counterDoesn't apply to most facts. Even invited guests get bitten.
Their tacticLow-ball based on bills alone
Our counterPermanent scarring is a separate damages category. We document the healing arc.
Their tacticHomeowner exclusion (breed-specific)
Our counterSome policies exclude certain breeds. We pursue alternate coverage and / or owner personal assets if needed.

06 · Common questions

Dog Bites -
straight answers.

Do I need to prove the dog had bitten someone before?

No. Kentucky's strict-liability statute (KRS 258.235) does not require a prior bite. The owner is liable for the first bite.

What if the owner doesn't have insurance?

Personal assets are available, though collection can be difficult. We always identify all potential coverage sources first (renter's, umbrella, business policies).

What about scarring?

Permanent scarring is its own damages category in Kentucky. Photographs across the healing arc are critical evidence.
