CALL YOUR LAW FIRM • COLYER LAW FIRM

We all love our pets, but some owners may not be as responsible as the rest of us. From certain pets, attacks on humans can be very dangerous and even cause serious personal injury. In 2020, across the U.S. there were reported over 1 million dog bites, 400,000 cat bites, and 45,000 bites from snakes.

Kentucky is a strict liability state. This means that there are laws to protect anyone who is injured in any way by an animal. The pet owner may be liable for any and all damages including personal injury, lost wages, medical bills, or death.

Kentucky's "Dog Bite Law"

Kentucky is a strict liability state.

In Kentucky, just like in many other states, laws referred to as "dog bite statutes" are in place to support victims of dog attacks and hold negligent pet owners accountable. As outlined in Kentucky Revised Statutes §258.235(4), dog owners are strictly liable if their dog causes injury to a person, livestock, or personal property. Strict liability means that owners are held responsible for any damages resulting from the attack, regardless of whether they were aware of the animal's aggressive tendencies beforehand. Unlike the "one bite" rule, this law offers no exceptions for animal owners.

When a dog bites, its owner can be legally accountable for the damages caused by the attack. This responsibility holds true regardless of the precautions taken by the owner to prevent such incidents. Under this statute, victims of dog bites in Louisville have the right to pursue compensation not only for the bite itself but also for any additional harm inflicted by the dog.

Regardless of the severity of the injury, it's crucial to see a doctor promptly after a dog bite. Even seemingly minor wounds can lead to serious infections if left untreated.

Seek immediate medical attention

What To Do After a Dog Bite Injury

While waiting for medical care, clean the wound thoroughly with soap and water, and apply an antiseptic ointment if available. Cover the wound with a clean bandage or cloth to prevent further contamination.

2 / 4

Apply basic first aid measures

Try to identify the dog and obtain the owner's name and contact information if possible. Taking photos of the dog, the injury, and any relevant conditions can also be helpful for documentation purposes.

3 / 4

Gather information about the dog and its owner

File a report with the appropriate authorities, such as animal control or local law enforcement. This helps ensure that the incident is properly documented and can prevent future attacks by the same dog. Additionally, consulting with an attorney experienced in dog bite cases can help you understand your legal options and pursue compensation for your injuries.
